These general conditions express all the obligations of the parties, in the context of the distance sale of goods to individuals. In this sense, the consumer is deemed to accept them unreservedly. The seller and the consumer agree that these terms of sale exclusively govern their relationship. The seller reserves the right to occasionally edit the general conditions. They are applicable as soon as they are published online. If a condition of sale were to default, it would be considered to be governed by the practices in force in the distance selling sector whose companies are headquartered in France.

The online shop of the website is edited by the association Hôtel de la Dentelle, registered under the Siret number : 35363849700019, which is the operator of this site. The Hôtel de la Dentelle offers the sale of lace and original creations from a catalogue accessible on the Internet.

Any order for a product appearing in the online shop of the website implies prior consultation of these general conditions of sale. Consequently, the consumer acknowledges to be fully informed of the fact that their agreement regarding the content of these general conditions does not require the handwritten signature of this document, to the extent that the consumer wishes to order online the products presented as part of the website shop. The consumer has the right to save or edit these general conditions, it being specified that both the saving and the edition of this document are their sole responsibility. As a consumer, the customer therefore has specific rights, which would be called into question in the event that the products or services acquired within the framework of the website would in fact have a relationship with his professional activity.

Article 3 : OBJECT :

 The purpose of these general conditions is to define the rights and obligations of the parties in the context of the online sale of goods offered by the seller to the consumer. These conditions concern purchases made by any customer, in France and abroad on the website.

 

  • Article 4 : ORDERS :

The consumer chooses the products he wants to purchase using the electronic catalogue and adds them to their cart online. After validation and payment of the order, it is transmitted to the seller from the website.

The products will be shipped to the address indicated by the consumer when ordering.

 

  • Article 5 : PRIX DE VENTE :

The prices of the articles are indicated in EUROS all taxes included (VAT rate: 20%) excluding participation in the processing and shipping costs. The prices of the items invoiced are those shown in the electronic catalogue at the time of the order. The seller reserves the right to change its prices at any time but the products will be charged on the basis of the rates in force at the time of registration of orders, subject to availability on that date. A contribution to the delivery costs is clearly mentioned on the final validation slip and the total amount to be paid. All orders regardless of origin are payable in EUROS.

Retention of title clause: the articles remain the property of the seller until the complete collection of the price.

 

  • Article 6 : ORDER PROCESSING AND SHIPPING :

The normal time for processing and shipping orders is 1 to 2 working days (excluding weekends, holidays and annual holidays) from the day after the day of receipt of payment.

Orders are shipped by La Poste to metropolitan France, the French Overseas Departments and Territories, by Colissimo delivered at home without signature or with signature for an amount greater than 100 €.

The sender reserves the right, in the event of failure of the Post Office, to use any other means of delivery in compliance with the deadlines and charges provided.

The processing and shipping times of orders may vary in case of stock shortage, delivery difficulties, or holiday periods that will then be reported to the customer.

 

 Article 7 : SHIPPING COSTS :

All orders are subject to a flat-rate contribution to the processing and shipping costs varying according to their destination, namely:

Zone 1: Metropolitan France + Corsica + Monaco: € 6.50 except for heavy objects that will be calculated at actual costs.

Zone 2: DOM (Overseas Departments) + Local authorities: €6.50. Guadeloupe, French Guiana, Martinique, Réunion, Mayotte, Saint Pierre and Miquelon, Saint Martin and Saint Barthélemy

Zone 3: TOM (Overseas Territories): 7,50€. New Caledonia, French Polynesia, Wallys and Futuna

Zone 4: European countries: 7,50€. Andorra, Austria, Belgium, Denmark, Finland, Germany, Greece, Great Britain, Ireland, Italy, Liechtenstein, Luxembourg, Madeira, Netherlands, Portugal, Sweden, Switzerland, Vatican, excluding any other country.

 

It is left to the consumer to check that they have mentioned, during the registration of their order, all the information useful for the delivery.

In the event of a return to the sender of the mail by post, due to an incorrect or incomplete address caused by the consumer, or the absence of removal of the item pending at the post office during the period allowed (15 days), the costs of forwarding are the exclusive responsibility of the consumer on the basis of the actual cost of postage of the object.

  • Article 8 : ORDER CONFIRMATION :

 In accordance with article 1369-2 of the Civil Code, the Hôtel de la Dentelle seller undertakes to confirm the customer’s order by means of an acknowledgement of receipt sent by e-mail. It will specify the content of the order, its cost, the method of payment retained and its delivery methods.

Concerning mail shipments followed by La Poste  (type follow-up letter, "Lettre Max", Colissimo), deposited in the mailbox of the recipient without signature, as well as letters and parcels delivered against signature (type registered mail, "Lettre Expert", Colissimo), the tracking and distribution information, available on the La Poste website, or on the Coliposte website, is deemed to be accurate and true and is binding as regards the effective delivery of the mail. Consequently, the seller may not, under any circumstances, be held responsible in case of disappearance or spoliation of the mail after its distribution attested by La Poste.

 

  • Article 9 : AVAILABILITY OF PRODUCTS :

The catalogue of the website is updated regularly according to the orders registered and the arrivals of goods of the day.

The Hôtel de la Dentelle will endeavour to satisfy the demands of the consumer and to fulfil orders for the latter’s items. However, the seller will not be required to accept all orders and will not be liable to the consumer in case of delay in delivery or temporary or permanent availability of products. Orders are considered and processed upon receipt of payment by the seller. In case of temporary or permanent unavailability of one or more products at the time of processing an order, the seller reserves the right to cancel the products in question of the order, whether it considers that their future availability is too distant in time or uncertain. In this case, the consumer may be asked to cancel or modify their order, accept a credit or refund if necessary.

  • Article 10 : RIGHT OF WITHDRAWAL:

In accordance with the provisions of the Consumer Code, the consumer has 14 clear days from the date of receipt of the package, to request the return, exchange or refund of one or more items of his order.

Only returned items will be taken back in their original packaging, complete and intact, and in perfect resale condition. Any item that has been damaged, or whose original packaging has been damaged will not be refunded or exchanged.

All publications, models and catalogues published by the Hôtel de la Dentelle are in no way taken back because they are intellectual property.

This right of withdrawal is exercised without penalty, it being understood that the return costs are the exclusive responsibility of the consumer. In the case of an exchange, the redirection will be at the consumer’s expense, according to the current scale on the website.

 

  • Article 11 : RETURN PROCEDURE :

Any return of goods must be the subject, in advance, of a request to the Hotel de la Dentelle by email at contact@hoteldeladentelle.com is updated regularly according to the orders registered and the arrivals of goods, or by phone at 04 71 74 80 02, specifying the order number and the items concerned by the return. Upon receipt of a return agreement number, the consumer has 14 days to return the items in question in their new condition and original packaging, taking care to attach the return agreement number to the package. 

It is up to the consumer to choose the appropriate method of return, and to protect the returned items from the vagaries of transport; knowing that the return costs are the exclusive responsibility of the consumer as well as the risks related to the return of the goods (loss or deterioration by the Post or the carrier). It is recalled that only items returned, and arrived, complete and intact, and in perfect resale condition, can be refunded. ( excluded models and publications of the Hotel de la Dentelle).

 

  • Article 12 : RESPONSIBILITY :

The proposed articles comply with the French legislation in force and the standards applicable in France. The photographs, texts, graphics, information and features reproduced and illustrating the articles presented are not contractual. Consequently, the responsibility of the seller cannot be engaged in case of error or omission in one of these photographs, texts or graphics, information or characteristics of the articles or in case of modification of the characteristics of the articles by the suppliers.   • Article 13 : CASE OF FORCE MAJEURE :

The responsibility of the Hôtel de la Dentelle cannot be engaged in the event of force majeure such as strikes, fires, natural disasters, or other, this list is not exhaustive.

  

  • Article 14 : PAYMENT :

Items can be paid for by:

Credit card when ordering in secure mode;

Cheque (payable in France only) payable to the Hôtel de la Dentelle (enter the order number on the back of the cheque) accompanied by your order form, subject to all necessary checks;

Bank transfer (all bank charges are the sole responsibility of the issuing customer);

Money order.

Until receipt of all sums due in full, the seller remains the owner of the delivered products and reserves the right to recover them by any means available to him in case of failure of the final payment.

 

  • Article 15 : INFORMATION TECHNOLOGY AND FREEDOM  :

The seller undertakes not to disclose to third parties the information provided by the consumer. These are confidential. They will be used by its internal services only for the processing of orders and only to strengthen and personalize the communication and product offer reserved for customers of the Hôtel de la Dentelle. This article shall not prevent the transfer or transfer of activities to a third party.

  • Article 16 : CLAIMS AND DISPUTE :

It is left to the consumer to check the conformity of the goods, within 48 hours of the actual delivery date (date attested by La Poste). Consequently, no complaint concerning the conformity of the delivered goods will be admissible after a period of 2 working days following the reception of this goods by the consumer. Similarly, no complaint concerning a postal delivery problem will be admissible after a period of 30 days following the effective date of shipment of the goods, communicated to the consumer by email.

The information provided by La Poste, in particular that available on their websites, and on this one, is deemed to be accurate and true and is binding as regards the actual delivery of the goods.

For all disputes relating to this contract between the seller and the buyer, the Commercial Court of Le Puy will have sole jurisdiction.

 

 

Article 18 : 2022 ANNUAL LEAVE :

The company’s annual leave for 2022 is set from 17 December 2022 to 2 January 2023 inclusive.

Please note that during these holidays, the website remains accessible to the public, and orders can be recorded normally. However, any order placed, as well as any order payment (cheque, transfer, money order) received during these periods, can only be processed after the holidays.

Any other use constitutes infringement and punishable under Intellectual Property unless prior authorization from the Hôtel de la Dentelle.  Hôtel de la Dentelle (HDLD) is a registered trademark of the INPI under national number 20 4 696 009.

Each PDF file is for the sole use of its buyer at the HDLD. Its reproduction and distribution, total or partial, are strictly prohibited under penalty of legal proceedings.

The printing of the pique is reserved for the buyer who can not in any case copy and share it, including free of charge. As part of a club or lace association, each member of the association who wishes to make this model must buy it individually from the HDLD. Any infringement goes against the copyright defined by the Intellectual Property Code.

The lace made from HDLD models for sale are the property of their author who is free to reproduce, photograph and share these photographs or sell these laces by including the name of the model and the author of the drawing: HDLD.

  • Article 20 : VOCATIONAL TRAINING

 1-Content of the training

For any vocational training action, a quote and a personalized training plan are established according to the student’s knowledge. If they are a beginner, they will follow all the planned modules. An agreement will then be signed between the student and the training center.

2-Teaching time

The preparation of the CAP and the BMA Art of lace requires a lot of personal work, teaching is provided in 30-hour weeks.

However, if the funding organization requires it and makes the express request, we can adapt to increase the teaching time to 35 hours per week. We nevertheless draw your attention to the fact that the training is very dense and that weeks of 35 hours of teaching are too heavy for many students.

 

3-Student attendance and absence

The student will have to sign a sign-in sheet every half-day of training in order to be able to prove his attendance with the funder.

Any absence must be reported to us either by phone (04.71.74.80.02) or by email (contact@hoteldeladentelle.com). In case of illness or force majeure, proof may be requested, and in both cases, the corresponding training hours may be postponed as far as possible.

Delays or early departures due to the trainee will not give rise to a reduction in the price of the training.

 

4-Hours

The workshop hours are as follows: Monday to Friday, 9am to 12pm and 2pm to 5pm. Please respect these times

The workshop is closed on weekends and holidays.

In the exceptional case where the funding agency requires the trainee weeks of 35h, teaching will be provided from 8:30am to 12pm and from 2pm to 5h30pm.

5-Annual closure

The Hotel de la Dentelle closes for a period of two weeks, usually during the Christmas school holidays. The dates are defined each year and communicated to the trainees in advance.

6-Registration and presentation for the exam

The CAP and the BMA Art of lace passing as a free candidate, it is the responsibility of the student to register for the exam at the rectorate. However, if you encounter any difficulties, do not hesitate to ask for help from our workshop manager.

It is not required to pass the CAP immediately after the end of his training, unless the funding body requires it, The student is free to attend the next session if they wish to have more time to practice and master the techniques discussed.

In this case, it is the student’s responsibility to check with his or her funding agency beforehand if this choice is not a problem.

6-Inscription et présentation à l'examen

Le CAP et le BMA Art de la dentelle se passant en candidat libre, il est de la responsabilité de l'élève de s'inscrire à l'examen auprès du rectorat. Si toutefois vous rencontrez des difficultés, n'hésitez pas à demander de l'aide auprès de notre responsable d'atelier.
